NOTICE OF PUBLIC HEARING
The Board of Commissioners of Flathead County, Montana, hereby gives notice, pursuant to Section 76-2-205(1), M.C.A., that it will hold a public hearing to consider a request from the Flathead County Planning Board to amend the text of the Flathead County Zoning Regulations (FCZR).
The proposed amendments include the following amendments to Chapter 2: modify §2.02.040 regarding the duty of the Planning Board; modify §2.01.020, §2.01.020(8), §2.04.020(5), §2.05.030(1), §2.06.030(1), §2.06.040(1), §2.06.045(2), §2.08.020(2 & 4), and §2.08.030(1)(B); remove dwelling unit, accessory(ADU) §2.06.045(8); remove §2.07.040(6) and §2.08.030(1)(D & F); modify §2.08.020(2, 4, & 7-9) regarding the process for amendments to zoning; renumber 2.08.050 to §2.09 and add process for creation of a new zoning district; add §2.10 regarding the process for site plan review; and move §2.09 Enforcement to §2.11.
The proposed amendments include the following amendments to Chapter 3: to change §3.04.020, §3.05.020, §3.06.020, §3.07.020, §3.08.020, §3.09.020, §3.10.020, §3.11.020, §3.12.020, §3.13.020, §3.14.020, §3.15.020, §3.16.020, §3.17.020, §3.21.020, §3.24.020, §3.25.020, §3.26.020, §3.28.020, §3.35.020, §3.36.020, §3.37.020, §3.38.020, §3.42.020, and §3.43.020 regarding the permitted use of manufactured homes; to change §3.11.020, §3.11.030, §3.12.020, §3.12.030, §3.13.020, §3.13.030, §3.14.020, §3.14.030, §3.15.020, §3.15.030, §3.16.020, §3.17.020, §3.35.020, §3.36.020, §3.37.020, §3.38.020, §3.41.020, §3.42.020, and §3.43.020 to move ADUs to a permitted use subject to site plan review; to change §3.21.020, §3.24.020, §3.25.020, §3.26.020, and §3.28.020 to allow ADUs as a permitted use; to modify §3.07.030, §3.08.030, §3.09.030, §3.10.030, §3.11.030, §3.12.030, §3.13.030, §3.14.030, §3.15.030, §3.16.030, §3.17.030, and §3.21.030 regarding manufactured home park conditional use to include mobile homes and removing subject to subdivision regulations; to remove subject to subdivision regulations from recreational vehicle park conditional use from §3.08.030, §3.19.020, §3.21.030, §3.28.030, §3.30.030, and §3.31.030; to modify §3.15.020 and §3.15.030 to allow for dwelling, multi-family (4 or fewer units) as a permitted use; to remove and modify definitions from §3.35.140, §3.37.130, §3.38.130, §3.38.120, and §3.42.090; update the average high-water to match recent surveys in §3.37.030; split §3.39 LS Lakeside into §3.39 LSR Lakeside Residential & LSC Lakeside Commercial §3.40 and add uses; to change from §3.40 to §3.41, from §3.41 to §3.42, and from §3.42 to §3.43, and to modify §3.43.020 and §3.43.030 to move dwelling, family hardship, farm/ranch/caretaker/employee housing, and guest house from a permitted use to an administrative conditional use permit.
The proposed amendments include the following amendments to Chapter 4: to modify §4.12 and §4.12.010 to include mobile homes; to add §4.12.020, §4.12.030, §4.12.040, §4.12.050, §4.12.060, §4.12.070, §4.12.080, §4.12.090, §4.12.100, §4.12.110, and §4.12.120 to include conditional use standards for a manufactured or mobile home park; and to modify §4.16.040 to include mobile homes.
The proposed amendments include the following amendments to Chapter 5: to modify §5.01.030(2, 3, & 7) to allow for ADUs to be built to the same height as the principal dwelling and allow ADUs to be permitted within the front yards; to remove §5.08.010(2); to amend §5.09.020(1) to allow for manufactured homes; and to add §5.14 to include performance standards for recreational vehicle park/campground.
The proposed amendments include the following amendments to Chapter 8: to add §8.05.145 dwelling unit, tiny definition, §8.07.005 factory-built housing definition, §8.09.035 home-based business definition, §8.13.083 mobile home definition, and §8.13.086 mobile home space definition; to amend the manufactured home definition in §8.13.010, the manufactured home park definition in §8.13.020, and lot area definition in §8.12.030; and remove the manufactured home subdivision definition §8.13.030.
The Flathead County Zoning Regulations apply in all County zoning districts created under Section 76-2-205, M.C.A., and are on file for public inspection at the Office of the Board of Commissioners, located at 800 South Main, Room 302 Kalispell, Montana, the Flathead County Planning and Zoning Office, 40 11th Street West, and on the Flathead County Planning and Zoning Office’s website at: https://flathead.mt.gov/department-directory/planning-zoning/documents-online. Documents related to the proposed amendments to the regulations are on file for public inspection at the Office of the Board of Commissioners and at the Flathead County Planning and Zoning Office.
The public hearing will be held on the 28th day of August, 2025 at 10 o’clock a.m. in the Commissioner’s Chambers, Third Floor, Old Courthouse, Kalispell, Montana. At the public hearing, the Board of Commissioners will give the public an opportunity to be heard regarding the proposed change to the text of the Flathead County Zoning Regulations.
Written comments are encouraged and will be reviewed by the Commissioners prior to the hearing if received by the Flathead County Commissioners’ Office at least three business days prior to the hearing.
