WHAT are BUILDINGS FOR LEASE OR RENT?

Buildings for Lease or Rent (BLR) that meet the requirements of these regulations include structures or a unit of structures for the permanent or temporary housing or enclosure of persons or property, or for the operation of a business. Examples of buildings that require BLR are apartment complexes, office buildings with 6 or more rentals, or mini-storage with 31 or more units rented out.

BLR is applicable in unzoned areas of Flathead County and areas zoned SC Scenic Corridor. Short-term rentals subject to the state lodging facility use tax are exempt from BLR review. The term does not include condominiums or townhomes.

Currently, BLR does not include recreational camping vehicles, manufactured homes, mobile homes, or cell towers. Flathead County Planning and Zoning will be updating the BLR Regulations to include cell towers, recreational camping vehicles, manufactured homes, and mobile homes as a result of SB 147 from the 69th Legislative Session. 

PURPOSE OF blr REGULATIONS

The purpose of the Flathead County Buildings for Lease or Rent Regulations are intended to provide an administrative process for the acceptance and review of applications for the creation of a building for lease or rent in unincorporated areas of Flathead County. The lease or rent of a building on a tract of record may directly impact the property and its surroundings with regard to vehicular access, public health, safety, and general welfare, the provision of public services and utilities, and the physical environment. These regulations are adopted for the purpose of considering and mitigating potential impacts resulting from a building proposed for lease or rent on a single tract of record, ensuring protection of the public’s health, safety, and general welfare.
